See what happens. Long as not a wear item or mods on car or something crazy it should be covered under warranty if you still have warranty on the car and by any dealer. If they will not do it I'd find another dealer to fix the issue. The diagnostic fee is BS in a way but hell they have to make $ I guess. I'd only charge you $149 ;-) LMAO!

Ok, so IF the car was mod'd, and the dealer refuses to fix car, THEN I should sue the dealership that sold it to me under the pretense of having an extended warranty. Otherwise, it sounds like Hyundai should honor the warranty and fix the CEL.

Yeah, I don't mind spending a little, but I just spent all my savings getting the car, and then some to do the work on my own.

One more question (maybe for @trdtoy ), I noticed that my car has the conical air filter on it (like in your avatar pic) , but did not think much of it when purchasing. Not being very familiar with these cars, is that stock or did someone remove the airbox and replace it? Maybe that is causing the misfires?

Unless the mods and warranty agreement is in writing then you're screwed in terms of warranty by most dealers and there is nothing you can do about especially if it has been documented.

The air filter setup is not OEM and will not cause the issue. Makes you wonder why the old owner traded it in and what all had been done to the car and how it was treated.

Update.

So, dealer said they have been looking at my car for about a week (had it there for 3 weeks now). They said aftermarket air intake may void warranty, the service alerts have been going off way before I bought the car, and that I cannot file a lemon law against other dealership I bought it from, since lemon law only applies to original dealerships.

Hoping they can still fix car, but may have to get a lawyer to settle this with the place I bought it from.

Good times.

Soooo...looks like the OG dealership I bought it from is going to help. But the Hyundai dealership says they need to replace the cold air intake with factory before they can determine what's causing the misfires. So...car now 4 1/2 weeks at dealership, will be another week or 2 to get the parts....rerun diagnostics.......yawn....

...after my last update they told me the had no idea when they could get the last part in they need to reinstall the factory airbox. So...I was able to get my car back , just 2 days under sitting at the dealer for 9 weeks. The turbo did make a strange sound, kind of high pitched grinding whistle while driving back home, but then went away. The good news is it's running great. After 6 days of driving, no CEL. I expect it to come back on any day now...but so far so good.

I still need to get the cold air intake replaced to get car into warrantable condition. Any offers on a used cold air intake system?

Getting the oem intake for a gen 2 is not an issue so not sure why they're having issues. Getting new or used in a week or less should be the norm.

I called the other dealer that is close to me. They said parts lead times are 2-6 weeks. The dealer I had it at did not order parts until car was there 2 or 3 weeks, so that's part of the delay. I'm giving them another 3 weeks and will call them at the start of the new year. Car's still running great with no CEL. Maybe it fixed itself? :)

That seems fishy as hell to me. Seems like they are just trying to get you to pay dealer prices to get more money out of you and waste your time. I would just buy it then tell them you found the oem one in your basement packed away and didn’t realize you still had it lol.

@DragonSlave02 For sure. They make some $$ off parts. After 3 months of working with them, I think they know my story by now, so I can't pull that on them. I already asked them about getting the parts for them and they seemed very off put by that suggestion. I didn't assume all the dealers had their parts in a central database, so I was going to go shopping for them. I was told they do have a centralized parts distribution system.

Fortunately, since I bought the car as "under factory warranty", the dealer I bought it from is paying to get the OEM airbox back on. And, after a week of driving , still no CEL !!
So, no big rush. Just glad I still don't have my car over there sitting in their parking lot.

Update:...now 3 weeks since I picked up car from shop...no CEL still (amazing), but they still have no ETA to order parts. Very strange they can't even order new parts for a car under warranty within 3 months. They also cannot let me order the parts, use 3rd party parts or used parts (in order to keep car under warranty).

That last part is not true at all. As long as they want the oem part on the car it does not matter where it comes from especially if you're paying for it. If they refuse you may as well find another dealer anyway. Matter of fact screw them and go to another one anyway they dumb.

Well...still trying to get dealer to order parts. Was not even able to get ahold of my service person this week. So...this is now almost 3 and a half months and my car has not been worked on yet. The bad news is I have to stick with them as the place I bought it from is paying for the OEM parts (whenever they can order them) and the service. The good news is I have been driving my car for more than a month and no CEL! And, I hit a new record of 41mpg on my way to work. This car is so nice.
